New York Asbestos Lawsuits

Asbestos is a harmful fiber that can lead to a variety of severe medical conditions, such as mesothelioma. A New York asbestos attorney is experienced in handling lawsuits seeking financial compensation for victims of asbestos exposure and their families. These cases can be complex, so it's important to have a mesothelioma lawyer on your side.

New York has had a long history of asbestos litigation and many residents were exposed to this dangerous substance. In recent years there have been more lawsuits filed against asbestos producers from the past than before. These cases stem from the recognition of a link between asbestos legal and diseases such as mesothelioma, lung cancer, and asbestosis. These companies were aware asbestos's dangers however, they failed to inform the employees and the public.

New York City is especially susceptible to illnesses caused by asbestos because of its older structures and construction sites. Brooklyn Navy Yard is a notoriously toxic area that continues to impact the surrounding community.

Mesothelioma is triggered by direct exposure to Asbestos Claim and many workers were exposed to it at work. Exposure to asbestos from the outside can result in mesothelioma. This includes spouses of asbestos-exposed workers who had their husbands' work clothes and came into contact with asbestos dust regularly.

The mesothelioma lawsuit can be expensive for defendants, especially when they are mistakenly identified as defendants. A study indicates that more than 3,600 lawsuits have been filed since 2014 in New York courts. This number could grow. Specialized asbestos law firms often advertise on TV during the day and encourage victims to submit claims, promising they will receive substantial settlements.

The defendants may be able mitigate some of the expenses arising from these cases by argument that their policy terms have expired or they are only responsible for a small portion of the amount of the claim. New York law does not have a clear rule on how to allocate responsibility when the alleged risk is of and outside the insurer's policies.

Asbestos-Related Illnesses

A variety of asbestos-related diseases can develop because of exposure to the harmful mineral. The condition known as mesothelioma is the most severe. Mesothelioma has caused the death of many people. Other asbestos-related illnesses include lung cancer, asbestosis, pleural plaques and the pleural effusion.

Mesothelioma is a rare but fatal disease caused by exposure to asbestos fibers that accumulate in the lungs, and can cause irritation to the lining of the chest cavity, ribcage, and abdominal cavity (the pleura). Inhaling these tiny fibers can result in scarring of the lungs known as asbestosis and occasionally, the formation of thickened patches on the pleura referred to as plaques on the pleura, or a more widespread fibrosis of the pleura called diffused pleural the fibrosis. Pleural plaques or diffuse fibrosis could reduce lung capacity as determined by a breathing test. They also cause pain and difficulty breathing, though they do not lead to cancer or mesothelioma.

The majority of the time, signs of asbestos-related illnesses don't show up until decades after the initial exposure. This is because it could take between 20 to 50 years for inhalation of asbestos-containing fibers to damage the lungs. People who are at risk of developing mesothelioma or any other asbestos-related conditions include workers who handled, washed and removed asbestos-containing products from their workplaces and spouses and children of those exposed to asbestos.

Other asbestos-related diseases, in addition to mesothelioma include laryngeal carcinoma and lung cancer and peritoneal, ovarian and peritoneal cancer. The most fatal form of mesothelioma is called ovarian cancer, but it's much less frequent than the general mesothelioma. It is typically diagnosed later than other forms of mesothelioma because it develops in the lining of the reproductive organs and the symptoms may be similar to those of other illnesses.

Many companies employed asbestos during the 20th century. They were aware that it was dangerous. They exposed thousands of people to asbestos because they failed to remove it from their products. Now, those exposed are able to sue for financial compensation. Many asbestos-related companies have filed for bankruptcy. The victims are now able to claim compensation from trust funds set up by bankruptcy courts.
